HOLD HARMLESS

In connection with my voluntary involvement in activities undertaken for, and with the participation and support of Fair Trade Fund ("Call and Response"), a nonprofit organization, I hereby agree, for myself, my heirs, assigns, executors and administrators to release and discharge Call and Response, its officers and directors, employees, agents and volunteers (the "Call and Response Parties") from all claims, demands, and actions for injuries sustained to my person and/or property as a result of my involvement in such activities, even where caused by the negligence of the Call and Response Parties, and I agree to release and hold the Call and Response Parties harmless from any cause of action, claim or suit arising there from.  I hereby attest that my attendance and involvement in such activities is voluntary, that I am participating at my own and sole risk, and that I have read, understand, and accept the terms and conditions of this release.

I hereby give the Call and Response Parties my consent to use any photograph, videotape, and/or sound recording made of me or in which I may be included in whole or part.  I grant permission to the Call and Response Parties to use such images and/or recordings for any purpose and in their discretion. Additionally, by signing this document, I release and forever discharge the Call and Response Parties from any and all claims or liabilities of any kind which may arise from the use of my likeness.  I acknowledge and agree that I will not receive any compensation in connection with any use of my likeness.

TERMS OF USE

You understand and agree that these terms set forth the legally binding terms and conditions for your use of the Website and Services, and the Website and Services are made available and provided to you exclusively under these Terms. By visiting, using or accessing Website and/or the Services, you agree to comply with and be bound by the Terms. If you wish to register as a Responder, you must read these Terms and indicate your acceptance during the registration process. Note, however, that these Terms apply to your access to and use of the Site and Services regardless of whether you register as a Responder. We reserve the right to terminate your use or access to the Services at any time for any reason, including, without limitation, if we learn that you have provided false or misleading information or have violated the Terms.

The contents of this website, including all images and text, are for personal, educational, non-commercial use only. Pictures and media on the Website belong to, have been donated, or otherwise deposited to the care of and are in the possession of the Fair Trade Fund for intended purposes. In many cases, the Fair Trade Fund does not own the copyright for pictures and film and therefore assumes no responsibility for violations of such rights or for any other legal issues resulting from the use or publication of the items. Therefore, the ultimate responsibility for determining existing and valid copyrights or other intellectual property protections lie solely with the Responder and the Responder holds Fair Trade Fund harmless from any asserted liability for the use.

All other elements of the Website, including without limitation the general design and the content, are protected by trade dress, copyright, moral rights, trademark, and other laws relating to intellectual property rights. You agree not to modify any documents, graphics, images, or other material found on this Website, or alter or remove any trademark, copyright, or other notice from copies of the content. Except as described in the following paragraph, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, rewrite, create derivative works from, transfer, or sell any material contained on this Website without the express prior consent of the copyright owner. You may, however make single copies of materials displayed on the Website for your own personal and noncommercial use to review volunteer or giving opportunities and/or events and promotional information, provided that any copies include the copyright and other legal and proprietary notices and other credits displayed with the materials on the Website. Except for the sharing of information with other volunteers and donors, you may not distribute such copies to others, whether or not for a charge or other consideration, without prior written permission from Fair Trade Fund or the copyright owner of the copied material.

Fair Trade Fund is not responsible, and shall have no liability, for any incorrect or inaccurate Content posted on the Website or any liability, cost or expense you may incur in connection with the Program. Fair Trade Fund cannot and does not verify the accuracy of information from Non-Profits or other field partners. Fair Trade Fund shall not be responsible, or have any duty or obligation to, or liability for: (a) decisions or interactions resulting (directly or indirectly) from participation in the Program; or (b) any damages, costs, losses or expenses a User incurs as a result (directly or indirectly) of making a donation or as a result (directly or indirectly) of utilizing the Program or information received in connection with the Program. In addition, in no event will Fair Trade Fund be liable to you or any third person for any damages, costs, losses or expenses, including any lost capital, lost profits or special, incidental, consequential or punitive damages arising from your use of the Website or participation in the Program, even if Fair Trade Fund has been advised of the possibility of such damages, costs, losses or expenses.

User Contributions to the Website

Opportunities exist for registered Responders to post information on the Website. These "Contributions" include, among others, posting comments in the Opensource Activism page. Fair Trade Fund does not assume any responsibility for the consequences of Contributions on or any communications or results arising from use of the Website. Fair Trade Fund does not represent or guarantee the truthfulness, accuracy, or reliability of any Contributions posted by users or endorse any opinions expressed by such users. ANY RELIANCE UPON CONTRIBUTIONS, AND THE OPINIONS EXPRESSED THEREIN, POSTED ON THIS WEBSITE IS AT YOUR OWN RISK.

You are solely responsible for your own Contributions and the consequences of posting those Contributions. You acknowledge that you have no expectation of privacy in anything you submit to Fair Trade Fund Website, and that any information posted on the Website is not confidential or private and can be read by anyone. By providing Contributions, you are granting to Fair Trade Fund and a worldwide, royalty-free, perpetual, nonexclusive, and irrevocable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and /or to incorporate it in other works in any form, media, or technology now or hereafter known. In addition, you warrant that all so-called “moral rights” in those materials have been waived.

Fair Trade Fund reserves the right to remove Contributions that are abusive, illegal, disruptive, or that otherwise fail to conform with these Terms. Fair Trade Fund reserves the right (but is not obligated) to edit or delete any Contributions posted on the Fair Trade Fund Website, regardless of whether such Contributions violate these standards for Contributions. Fair Trade Fund reserves the right (but is not obligated) to monitor, edit, disclose, or record any type of Contributions for adherence to these Terms. Fair Trade Fund may exercise these rights if required, in the course of normal operations and maintenance of the Fair Trade Fund Website, or by law or in the good faith belief that such action is necessary to (i) comply with the law or with legal process served; (ii) protect and defend the rights of Fair Trade Fund or others; or (iii) act in an emergency to protect the personal safety of our users or the public. FAIR TRADE FUND HAS NO LIABILITY OR RESPONSIBILITY TO USERS OR ANY OTHER PERSON OR ENTITY FOR PERFORMANCE OR NONPERFORMANCE OF THE AFOREMENTIONED SCREENING ACTIVITIES.

Prohibited Actions

By using the Website, you agree not to do any of the following:

Post, distribute, upload, transmit or otherwise make available material which infringes and/or violates any right of a third party or any domestic or international law, rule, or regulation, including copyright, trademark, patent, trade secret, or other proprietary rights or rights of publicity or privacy of third parties;
  2. Post, distribute, upload, or otherwise make available or transmit material that we deem to be: (a) defamatory, abusive, harassing, insulting, threatening, or that could be considered to be stalking; (b) bigoted, hateful, racially offensive, or personal attacks of any kind; (c) vulgar (e.g., profanities and expletives), obscene, or sexually explicit or pornographic (language or images); or (d) that encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them;
  3. Advertise or sell any products, services or otherwise (whether or not for profit), or solicit others or use this Website for commercial purposes of any kind;
  4. Use Fair Trade Fund or this Website to promote any activity that may be found illegal at the local, state, or federal level (including, but not limited to, laws governing export control, consumer protection, unfair competition, antidiscrimination, or false advertising), or any content that is itself illegal in any way, such as fraudulent advertising or advertising involving the sale of counterfeit or stolen items;
  5. Post, distribute, upload, transmit, or otherwise make available any executable programming of any kind, such as viruses, worms, Trojan horses, spyware, time bombs, cancelbots, easter eggs, or any form of malicious or benign computer programming whatsoever;
  6. Post, distribute, upload, transmit, or otherwise make available or engage in "junk mail," "chain letters,” unsolicited mass mailing or advertising emailing ("spamming"); "flaming," "flooding," "trolling," or "griefing," as those terms are commonly understood on the Internet;
  7. Identifiably impersonate another individual, by false representations in the text, by creating a misleading screen name that misrepresents the poster’s identity in an identifiable fashion, or by using another individual’s account to post, with or without that individual’s knowledge, or allow another person to use your identification to post or view comments or solicit passwords or personal identifying information from other users;
  8. Post, distribute, upload, transmit, or otherwise make available (a) direct links to or descriptions of goods and services that are prohibited under these Terms, (b) multimedia Content of any kind, such as audio and video files, (c) content that is untrue, inaccurate, deliberately misleading, or trade libelous, (d) encrypted content or content that can be demonstrated to contain encoded messages, and/or (e) content that creates liability for us or causes us to lose (in whole or in part) the services of our ISPs or other partners or suppliers.

Any violation of these Terms may result in the termination of your right to use the Website without notice.

Ticket Sales, Fee Payment, and Donation Policy

Through the Website, tickets are sold to the Call+Response film which may either (i) require check-in at the door for an event where no paper tickets are issued, or (ii) require a physical ticket for a ticketed event. Fair Trade Fund processes ticket fees and donations. Please allow sufficient time for the delivery and or confirmation of your ticket and donation. If you have selected delivery by mail, please allow at least fourteen (14) business days after your order is placed to receive your tickets. For express delivery, allow at least two (2) business days. These are approximate times, and Fair Trade Fund is not responsible for deliveries that take longer. Will call orders can be processed up to the day of the event. If you have not received your tickets within 48 hours of the event, please contact us. Occasionally, screening events may be cancelled or postponed by Fair Trade Fund. If the event is cancelled, please contact us for information on receiving a refund.

Remedies for Violations

We reserve the right to seek any and all remedies available at law, in equity or otherwise for violations of these Terms of Service, including, but not limited to, the right to block access to the Services from a particular Internet address.

Governing Law and Jurisdiction

These Terms of Service are governed by, and construed in accordance with, the laws of the U.S. and the State of California, without giving effect to its conflicts-of-law principles. You agree to submit to the personal jurisdiction of the federal and state courts located in the State of California with respect to any legal proceedings that may arise in connection with the Services or from a dispute as to the interpretation or breach of these Terms of Service.

The following statement discloses the privacy policy for the Call+Response website (the “website”) operated by Fair Trade Fund located at www.callandresponse.org. By visiting this website, you are accepting the practices described in our Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the website and exit immediately. We reserve the right to modify or amend the terms of our Privacy Policy from time to time without notice. Your continued use of our website following the posting of changes to these terms will mean you accept those changes.

Fair Trade Fund takes precautions to keep the donor information disclosed to us secure, and Fair Trade Fund will not intentionally disclose such information to third parties for commercial purposes. To prevent unauthorized access, maintain data accuracy, and to ensure the appropriate use of information, we have put in place electronic safeguards, as well as, internal organizational procedures to safeguard and secure the information that you provide.

Fair Trade Fund is the sole owner of the information collected on this website. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. As described below, Fair Trade Fund collects information from our users at several different points on our website.

Non-profit partners who have posted projects on this website do not have access to personally identifiable information.

Registration, Ticket Sales, Payments and Donations

In order to register on this website to contribute to projects, to submit contributions to comment pages or to buy tickets to film screening events, you must complete the registration form. During registration, you are required to give your name, contact information, and other information requested in the registration process. Fair Trade Fund uses this information to contact you about its events and projects and other services from our website for which you have registered or expressed interest. When you pay for tickets or make financial contributions through this website, financial information is collected from you, such as your credit card number and expiration date. Your financial information is used for processing payments. If we have trouble processing a payment or donation, Fair Trade Fund may use this contact information to get in touch with you.

When you make an online donation to projects on the website, credit card or bank account numbers are collected by a third-party payment vendor such as Vantage and Verisign. These partners' use of your information is based on their terms of service and policies, which you should review. Fair Trade Fund will collect only your donation information and history but we do not collect or have access to the credit card numbers or bank account information our third-party vendors (Vantage and VeriSign) collect to process online transactions.
Newsletters, Information, Reporting and Other Announcements

Fair Trade Fund sends all donors and responders and may send buyers of tickets a confirmation e-mail verifying the transaction. Donors and Responders may occasionally receive information on Fair Trade Fund projects or activities, or a newsletter if they have signed up to receive such updates. Those who donate to a particular project will receive update and impact reports from that particular project. Out of respect for the privacy of our users, we present the option not to receive these types of communications. If a user would like to opt out of receiving such information, they may email us at info@callandresponse.com.

Updating and Correcting Personal Information

If your personally identifiable information (such as your email address) changes, we will attempt to provide a way to correct, update, or remove the personal data that you have provided to us. This can usually be done on the website information page or by emailing us at info@callandresponse.com.
